Tim West on Changes to Missouri Expert Witness Rules

Berkowitz Oliver partner Tim West recently wrote an article regarding Missouri Governor Eric Greitens’ comments concerning changes to the admissibility of expert witness testimony in civil cases in Missouri. Berkowitz Oliver partners Tim Millman and Nick DiVita won a jury verdict for client Ford Motor Company in federal court in Chicago on Tuesday, April 11, 2017. The plaintiff in the case claimed he was discharged in retaliation for seeking workers’ comp benefits and sought millions in alleged damages. Ford is a Fortune 100 company and long-time client of Berkowitz Oliver.

In this case, the plaintiff alleged defamation and intentional infliction of emotional distress arising out of a Golf.com article concerning Hillcrest Country Club. Berkowitz Oliver was proud to be a sponsor of the 2017 Shields SAFEHOME Youth Soccer Clinic on February 20, 2017. The successful event provided 77 youth with the opportunity to interact with NFL Hall of Fame member Will Shields, receive coaching from FC Kansas City and Comets players, and learn about healthy relationships from SAFEHOME’s Education staff. SAFEHOME’s Education and Prevention Program provides school and community-based outreach to teach young people about teen dating violence, sexual assault, and healthy relationships.

False Claims Act Dismissal Obtained by Nick Kurt

Nick Kurt recently obtained a dismissal of a claim brought under the False Claims Act (“FCA”) against Quicken Loans in federal court in Kansas. The Court adopted Nick’s analysis and held that the plaintiff failed to comply with the procedural requirements of the FCA. The Court also held that the plaintiff failed to state a claim establishing liability under the FCA. Morris, DiVita and Wieland Obtain Federal Court Dismissal for Lack of Personal Jurisdiction

Berkowitz Oliver partners Jeff Morris , Nick DiVita and Jennifer Wieland recently obtained a complete dismissal of their clients from a lawsuit filed in federal court in Kansas. The Court held there was no personal jurisdiction in Kansas over non-residents Smaller Earth, Inc. and Camp Leaders USA.
