U.S. Department of Labor Issues FAQs Regarding New Paid Leave laws
The U.S. Department of Labor (DOL) has issued additional guidance on the Families First Coronavirus Response Act (FFCRA) by providing a series of FAQs. In the FAQs, the DOL addresses a number of issues including calculation of the 500-employee threshold, potential exemptions for small businesses (fewer than 50 employees), calculating rates of pay, documentation requirements, telework, intermittent leave, furloughs, and “top off” policies. A link to the FAQs can be found here.
In addition, the DOL has provided the new poster that will fulfill the April 1, 2020 notice requirements for employers obligated to inform employees about their rights under this new law. The poster for private employers can be found here, and the DOL’s FAQs regarding the posting requirements can be found here.
